Express Entry

Canada's Express Entry program is a federal immigration program that manages the selection of skilled workers who want to immigrate to Canada and become permanent residents. The program is designed to help Canada attract and retain highly skilled workers who can contribute to the country's economy and society.

The Express Entry system operates on a points-based system, where eligible candidates are given a Comprehensive Ranking System (CRS) score based on factors such as their age, education, language proficiency, work experience, and other factors. Candidates with the highest CRS scores are then invited to apply for permanent residency through regular Express Entry draws, which take place approximately every two weeks.

There are three federal economic immigration programs that are managed through the Express Entry system:

  • Federal Skilled Worker Program (FSWP)
Targets skilled workers with foreign work experience who have the skills and experience needed to fill labour shortages and contribute to the Canadian economy.
  • Federal Skilled Trades Program (FSTP):
Targets skilled tradespeople who want to immigrate to Canada and become permanent residents.
  • Canadian Experience Class (CEC)
Targets individuals who have Canadian work experience and are already familiar with Canadian society and culture.

Sponsorship

Sponsorship is a popular pathway for individuals who wish to reunite with their family members in Canada. The Canadian government is committed to family reunification and has several programs in place to facilitate the sponsorship of eligible family members.

Sponsorship in Canada refers to the process by which a Canadian citizen or permanent resident can sponsor their eligible family members to come to Canada and become permanent residents. The family members who can be sponsored under Canadian immigration law include spouses, common-law partners, conjugal partners, dependent children, parents, and grandparents.

Once the sponsored family member is approved for permanent residency, they will be able to live, work, and study in Canada, and will have access to social services and healthcare, just like Canadian citizens and permanent residents.

Canadian PR

Canadian Permanent Residency (PR) is a status granted to individuals who are not Canadian citizens but have been given permission to live and work in Canada on a permanent basis. PR status allows individuals to enjoy many of the same rights and benefits as Canadian citizens, including access to healthcare, education, and social services.

Once an individual obtains Canadian PR, they must meet certain residency requirements to maintain their status. They must reside in Canada for at least two out of every five years to maintain their PR status. PR status can also be lost if an individual commits a serious crime or becomes inadmissible to Canada.

Refugee and H&C (Humanitarian & Compassionate) Programs:

In Canada, refugee and Humanitarian and Compassionate (H&C) applications are part of the immigration system designed to protect individuals who are outside of their home country and are unable or unwilling to return due to a well-founded fear of persecution, risk to their life, or cruel and unusual treatment or punishment.

A refugee claim is made by an individual who is seeking protection in Canada and who meets the definition of a refugee as outlined in the United Nations Convention Relating to the Status of Refugees. If the claim is accepted, the individual will be granted refugee status in Canada and will be eligible to apply for permanent residence.

The H&C category is for individuals who are in Canada and do not meet the requirements of the refugee system but have compelling and humanitarian reasons to remain in Canada. These may include, but are not limited to, the best interests of a child, family separation, and medical conditions.

The H&C application is a discretionary program that is assessed on a case-by-case basis, taking into account the individual's personal circumstances, establishment in Canada, and the humanitarian and compassionate grounds of the application. If the H&C application is approved, the individual may be granted permanent residence in Canada.

Both refugee and H&C applications are assessed by the Immigration and Refugee Board of Canada (IRB) or by the Canada Border Services Agency (CBSA) at the Refugee Protection Division (RPD) or the Immigration Division (ID), respectively. This is one of our specialties in fact! The Arise team has represented many clients with Refugee and H&C cases successfully and we are eager to help you or your loved one in such a situation. Canada has a long history of welcoming refugees and is committed to ensuring the protection of individuals who are in need of humanitarian assistance.
